27.3 Vibe Affirmations API – Additional Terms

Effective Date: December 26, 2025

These additional terms supplement the ApiaryLabs Terms of Use (Sections 1-26) and apply specifically to the Vibe Affirmations API. In case of conflict, these service-specific terms prevail.

Plain English Summary

Vibe Affirmations provides motivational content in 9 different personality styles (vibes). You get cached affirmations (fast and free) or custom AI-generated affirmations (bring your own OpenAI key). Don't resell the affirmations, abuse the API, or use it for harmful purposes. Subscription tiers control which vibes you can access. The content is for motivation, not medical/legal/financial advice.

Definitions

For purposes of the Vibe Affirmations API:

• "Affirmation" means a short motivational phrase, quote, or statement generated or cached by the Service.
• "Vibe" means a personality style or tone (e.g., Stoic, Hype, Roast, Zen, Savage, Scholar, Cosmic, Therapist, Drill Sergeant).
• "Cached Affirmation" means pre-curated content stored by the Service, refreshed periodically, and delivered without AI generation.
• "Live Affirmation" means custom AI-generated content created in real-time using OpenAI's GPT-3.5-turbo model.
• "BYOK" (Bring Your Own Key) means you provide your own OpenAI API key for live AI generation.
• "Tier" means your subscription level (Free/Basic, Pro, or Premium) which determines accessible vibes.

Additional Permitted Use

In addition to general permitted uses under Section 3.1 of the main ApiaryLabs Terms, you may:

• Display Affirmations in your applications, websites, mobile apps, or browser extensions
• Cache Affirmations for up to 24 hours per Section 5.3 of the main Terms
• Attribute content to "Vibe Affirmations API" or "Powered by Vibe Affirmations"
• Use Affirmations for personal motivation, wellness apps, productivity tools, or mental health support
• Integrate Affirmations into push notifications, chatbots, Slack/Discord bots, or voice assistants
• Generate custom Affirmations with your own OpenAI API key (BYOK model)
• Access demo endpoints without authentication for evaluation purposes (100 requests/day limit)
• Customize Affirmations by selecting specific vibes based on user preferences or context
• Combine Affirmations with your own content, images, or user-generated content

Additional Prohibited Use

In addition to prohibited uses under Section 3.2 of the main ApiaryLabs Terms, you must not:

• Compete: Build a competing motivational affirmations API or content resale service
• Bulk Archive: Systematically scrape or archive all Affirmations to build a competing dataset
• Remove Attribution: Claim Affirmations as your own original content or remove "Powered by Vibe Affirmations" attribution
• Tier Bypass: Attempt to access vibes outside your subscription tier through technical exploits
• Harmful Content: Use the Service to generate, display, or distribute harmful, hateful, violent, or illegal content
• Medical Claims: Present Affirmations as medical advice, therapy, or treatment for mental health conditions
• Automated Abuse: Generate excessive AI affirmations to deplete other users' OpenAI quotas or abuse the BYOK model
• Misinformation: Use Affirmations in contexts that spread misinformation or deceptive content
• Child Exploitation: Target children under 13 without parental consent or violate COPPA regulations
• Discriminatory Use: Use Affirmations to discriminate based on race, religion, gender, sexual orientation, or disability

• Does NOT constitute medical, psychological, legal, financial, or professional advice
• NOT a substitute for professional therapy, counseling, or mental health treatment
• You are solely responsible for how you use and interpret Affirmations
• Consult qualified professionals for medical, legal, or financial decisions

No Guarantees:

• Affirmations are provided "as is" without warranties of effectiveness or accuracy
• We do not guarantee Affirmations will improve mood, productivity, or mental health
• Results vary by individual—what motivates one person may not work for another
• Cached Affirmations may repeat or become stale (refreshed periodically)
• AI-generated Affirmations may vary in quality or relevance

Third-Party AI Dependency (Live Affirmations):

• Live Affirmations use OpenAI's GPT-3.5-turbo model (you provide the API key)
• Content quality depends on OpenAI's model performance and your prompts
• OpenAI's Terms of Service and Privacy Policy apply to AI-generated content
• We are NOT responsible for inappropriate or unexpected AI-generated content
• You control AI costs directly through your OpenAI account (BYOK model)

Emotional Well-Being:

• If you're experiencing a mental health crisis, contact a qualified professional immediately
• Crisis hotlines: National Suicide Prevention Lifeline (US): 988, Lifeline (AU): 13 11 14
• Affirmations supplement—but do NOT replace—professional mental health support

Subscription Tiers & Access

Tier-Based Vibe Access:

Enforcement:

• Requests for vibes outside your tier will return 403 Forbidden
• Tier validation occurs server-side—you cannot bypass it
• Upgrade your subscription anytime on RapidAPI Hub
• Downgrades take effect at the end of your billing cycle

Demo Endpoints (No Authentication):

• Demo endpoints (/demo/affirmation, /demo/vibes) do NOT require authentication
• Rate limited to 100 requests/day per IP address
• Intended for evaluation and testing only
• Production use requires a paid subscription

BYOK (Bring Your Own Key) Model

Live AI Generation:

• To use POST /affirmation/live, you must provide your own OpenAI API key
• You are responsible for OpenAI API costs (billed directly by OpenAI)
• We do NOT mark up OpenAI charges—you pay OpenAI's published rates
• API keys are passed in request headers and never stored by us
• You control which topics are sent to OpenAI (we don't log or store topics)

Your Responsibilities:

• Comply with OpenAI's Terms of Service and Usage Policies
• Monitor your OpenAI usage and costs
• Do NOT share your OpenAI API key or expose it in client-side code
• Understand that AI-generated content may contain errors, biases, or unexpected outputs

Disclaimer:

• We are NOT responsible for OpenAI service outages, rate limits, or content quality
• Live Affirmations may take 1-3 seconds to generate (depending on OpenAI response time)
• If OpenAI's API fails, you will receive an error response

Rate Limits & Quotas

Tier-Based Limits:

• Free/Basic: 500 requests/month (cached endpoints only)
• Pro: 5,000 requests/month (cached + live AI with BYOK)
• Premium: 50,000 requests/month (all features)

Burst Limits:

• Free: 10 requests/minute
• Pro: 50 requests/minute
• Premium: 100 requests/minute

Overage Policy:

• Requests beyond your monthly quota return 429 Too Many Requests
• Upgrade to a higher tier for more quota
• Enterprise pricing available for 1M+ requests/month (contact sales)

Data Privacy & Retention

What We Collect:

• Request metadata: timestamp, vibe requested, subscription tier, response status
• Performance metrics: latency, error rates, tier violations
• IP addresses: for demo endpoint rate limiting only (not logged long-term)

What We DO NOT Collect:

• Personal information (name, email, phone)—handled by RapidAPI
• Custom topics sent to live AI endpoints (ephemeral processing only)
• OpenAI API keys (passed in headers, never stored)
• User-generated content or affirmations you create

Data Retention:

• CloudWatch logs: 7 days
• Metrics: 15 months (AWS CloudWatch standard retention)
• No long-term storage of request payloads

GDPR Compliance:

• Service is GDPR-compliant (no personal data processed or stored)
• Right to erasure: N/A (no personal data retained)
• Data portability: N/A (stateless API)

Service Availability & SLA

Uptime Targets:

• Free/Basic: Best effort (no SLA)
• Pro: 99% uptime target (no financial guarantees)
• Premium: 99.9% uptime target (credit for extended outages)
• Enterprise: Custom SLAs available

Planned Maintenance:

• We may perform maintenance with 24-hour notice (when possible)
• Emergency maintenance may occur without notice
• Status updates posted on RapidAPI status page

No Liability for Downtime:

• We are NOT liable for business losses due to service interruptions
• Third-party dependencies (AWS, OpenAI, RapidAPI) may cause outages
• Use caching and fallback strategies for production applications

Intellectual Property

Cached Affirmations:

• Curated by ApiaryLabs—some inspired by public domain wisdom (Stoic philosophers, etc.)
• You receive a non-exclusive, non-transferable license to display Affirmations
• Attribution required: "Powered by Vibe Affirmations API"
• You may NOT resell or redistribute raw Affirmations as a standalone product

AI-Generated Affirmations:

• Generated by OpenAI's GPT-3.5-turbo model using your API key
• Ownership determined by OpenAI's Terms of Service
• You are responsible for compliance with OpenAI's usage policies
• We do NOT claim ownership of AI-generated content

API Branding:

• "Vibe Affirmations," "Vibe Check," and related branding are trademarks of ApiaryLabs
• You may NOT use our trademarks to imply endorsement or partnership without written permission

Termination & Suspension

We may suspend or terminate your access for:

• Violating these Terms or the main ApiaryLabs Terms of Use
• Abusing rate limits or attempting to bypass tier restrictions
• Using the Service for harmful, illegal, or discriminatory purposes
• Non-payment (handled by RapidAPI billing)
• Security incidents (compromised API keys, fraudulent activity)

You may cancel anytime:

• Cancel subscriptions through RapidAPI Hub
• Access continues until the end of your billing period
• No refunds for partial months (per RapidAPI policy)

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Service provided "AS IS" without warranties of fitness for any purpose
• We are NOT liable for emotional distress, business losses, or indirect damages
• Total liability capped at amount paid in the 12 months prior to the claim
• Free tier users: liability capped at $50 USD

You acknowledge that:

• Affirmations are subjective and may not resonate with everyone
• Some vibes (e.g., Roast) use sarcasm and may not suit sensitive users
• AI-generated content may contain errors, biases, or unexpected outputs

Changes to Terms

We may update these terms at any time. Changes effective immediately upon posting. Continued use of the Service constitutes acceptance of updated terms. Material changes will be communicated via email (if you've provided one to RapidAPI) or through the RapidAPI dashboard.

Governing Law

These terms are governed by the laws of Queensland, Australia. Disputes subject to the jurisdiction of Brisbane courts. For international customers, you waive rights to class-action lawsuits and agree to binding arbitration (per main ApiaryLabs Terms).
